On June 26, 2015, U.S. Supreme Court ruled that banning same-sex marriage is unconstitutional in all of the 50 states, including Michigan.
“The Fourteenth Amendment requires a State to license a marriage between two people of the same sex and to recognize a marriage between two people of the same sex when their marriage was lawfully licensed and performed out-of-State,” the court found in a 5-4 decision.
Joint adoptions, tax filings are now possible for gay couples in Michigan, and across the nation, along with improved status in matters of insurance, hospital visitation, estate planning and other spousal rights and benefits. In addition, U.S. citizens or permanent residents may now sponsor their same sex partners and take advantage of such immigration benefits as: green cards and finance visas.
Is it possible to obtain a green card based on same sex marriage in Michigan?
A U.S. citizen or legal permanent resident has a right to file an I-130 visa petition to sponsor his or her foreign-born spouse. To get a green card based on a sex-same marriage, you must be legally married, either in the U.S. or abroad. And you must be able to demonstrate that the legal marriage is based on a genuine, bona fide relationship. If you and your spouse entered into a legal marriage in any of the U.S. states, including Michigan, you may also apply for a green card using the adjustment of status rout, provided that your nonimmigrant spouse is already in the United States.
